Cousins, a drain which began on the suspect’s set forth passed at a lower place other houses and received their drainage and hence returned under the plaintiff’s set forth and passed beneath the plaintiff’s house.

The defendant was ignorant even of the existence of the return drain. He was held reasonable for nuisance. It is probable, however, that the principle of Ryla nds v. Fletcher though not referred to in th! e slip of story would justify the decision, as suggested in Winfield on Torts.
